Welcome to Topvapewholesaler. These Terms & Conditions  govern your access to and use of our website and any purchases made through the Site.


By accessing the Site or placing an order, you agree to be bound by these Terms and our related policies posted on the Site (including our Shipping & Handling and Warranty/Return policy). If you do not agree, please do not use the Site.

1) What We Sell (Important Disclaimer)

We are a wholesale supplier of empty hardware and packaging. Our products include empty disposable vape pens and packaging for cannabis oil (hardware/packaging only).

  • No cannabis oil, THC, nicotine, or any controlled substances are included or sold.

  • Buyers are responsible for ensuring their use, resale, and distribution comply with all applicable laws and regulations in their jurisdiction.

    2) Eligibility & Account Responsibility

    You represent that you are:

    • At least 21 years old, or the legal age in your jurisdiction to purchase vaping-related hardware and packaging; and

    • Using the Site for lawful purposes.

    If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately if you suspect unauthorized access.

    3) Wholesale / Business Use

    Our Site is designed for business and wholesale purchasing. You may use the Site to:

    • Browse products, request quotes, and place wholesale orders for your business.

    You may not:

    • Copy, scrape, harvest, or use automated tools to extract pricing/content;

    • Misrepresent your business identity or use the Site for fraud;

    • Use our brand assets, product photos, or text without permission.

    We reserve the right to approve, refuse, suspend, or terminate accounts/orders at our discretion if we believe activity is unlawful, abusive, or harmful to our business or other customers.

    4) Pricing, Quotes & Product Information

    We strive to display accurate product details, inventory status, and pricing. However:

    • Product specifications, packaging, and availability may change without notice.

    • Pricing errors may occur. If an item is listed incorrectly, we may cancel the order and issue a refund (or contact you for next steps).

    Wholesale pricing may depend on quantity, stock location (USA stock vs. other), and customization requirements.

    5) Orders, Payment & Acceptance

    Placing an order is an offer to purchase. We may accept or reject any order for reasons including (but not limited to):

    • Stock limitations

    • Pricing or listing errors

    • Address verification issues

    • Fraud prevention review

    An order is considered accepted when it is confirmed for shipment.

    We may request additional verification for high-value or bulk orders.

    6) Taxes & Resale Documentation

    You are responsible for any applicable taxes required by your local/state rules. If your purchase qualifies for resale/tax exemption, you may be required to provide valid documentation according to the rules applicable to your jurisdiction.

    7) Shipping & Handling (USA Warehouse Advantage)

    7.1 Shipping Locations & Split Shipments

    We may ship from different warehouses depending on inventory. For multi-item orders, we may split shipments to ship the fastest available stock.

    7.2 Processing Time

    Processing times depend on stock status and order type:

    • USA stock wholesale orders typically ship within 1–2 business days after payment confirmation (excluding weekends/holidays).

    • Custom/OEM orders follow the production schedule provided during confirmation.

    7.3 Delivery Estimates

    Delivery times shown on the Site are estimates and are not guaranteed. Carrier delays, weather, peak seasons, address issues, or other events may affect transit times.

    7.4 Address Accuracy

    You are responsible for providing a complete and correct shipping address. If a package is returned or delayed due to address errors, additional shipping fees may apply.

    7.5 Risk of Loss / Title

    Unless required otherwise by applicable law, risk of loss transfers to the buyer once the shipment is handed to the carrier. Orders marked “delivered” by the carrier are considered delivered.

    8) Returns, Warranty & Missing/Damaged Packages

    Our return/warranty rules are described in our Warranty / Return Policy on the Site.

    If your order arrives damaged or incomplete, contact us within 48 hours of delivery with:

    • Order number

    • Photos of outer carton, inner packaging, and affected items

    • A brief description of the issue

    We will verify and provide a reasonable solution (replacement, credit, or other remedy depending on the case).

    9) Prohibited Content & Customer Conduct

    You may not upload, post, or transmit content that:

    • Infringes intellectual property rights;

    • Is defamatory, threatening, obscene, or unlawful;

    • Contains malware, viruses, or harmful code.

    We also do not tolerate abusive behavior toward our support team. We may restrict service if communication becomes threatening, harassing, or unreasonable.

    10) Reviews, Comments & Submissions

    If you submit reviews, comments, photos, videos, or other materials (“Submissions”), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and display those Submissions for marketing and operational purposes (e.g., on product pages, social media, and customer service).

    You confirm that:

    • You own the rights to what you post; and

    • Your Submission does not violate any third-party rights or laws.

    We may remove or refuse to publish Submissions at our discretion.

    11) Intellectual Property

    All Site content, including text, product images, graphics, logos, page design, and compilation of content, is owned by us or licensed to us and is protected by intellectual property laws.

    You may not use our trademarks, brand name, product photos, or written content without our prior written consent.

    12) Intellectual Property Infringement Notice

    If you believe content on our Site infringes your trademark/copyright, please contact us and provide:

    1. Your name and contact information

    2. Proof of your rights (registration or evidence of ownership)

    3. The specific URL(s) where the allegedly infringing content appears

    4. A clear description of the claim and requested action

    5. A statement that your claim is accurate and made in good faith

    We will review and take appropriate action where necessary.

    13) Limitation of Liability

    To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from:

    • Your use of the Site,

    • Product misuse,

    • Carrier delays or delivery issues beyond our control,

    • Loss of profit or business interruption.

    Our total liability for any claim related to an order will not exceed the amount you paid for that specific order.

    14) Indemnification

    You agree to defend, indemnify, and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from:

    • Your breach of these Terms,

    • Your unlawful use or resale of products,

    • Your violation of third-party rights.

    15) Termination

    We may terminate or suspend your access to the Site and/or cancel orders if we believe you violate these Terms or applicable laws.

    Termination does not affect obligations that arose before termination (e.g., payment obligations, dispute resolution).

    16) Force Majeure

    We are not responsible for delays or failures due to events beyond our reasonable control, including but not limited to natural disasters, carrier disruptions, customs delays, labor disputes, war, or governmental actions.

    17) Disputes, Arbitration & Governing Law (Choose One)


    Any dispute arising from these Terms or your purchase shall be submitted to arbitration administered by Shenzhen Court of International Arbitration (SCIA). The arbitration shall be conducted in English, and the award shall be final and binding. These Terms are governed by the laws of the People’s Republic of China (excluding conflict of laws rules).

    18) Changes to These Terms

    We may update these Terms from time to time. The “Last Updated” date will change accordingly. Continued use of the Site after changes means you accept the updated Terms.
